LEGALIZATION OF WORK CONTRACT

Step 1

An employer fills in Employment Contract(s) in English and also Legalization Work Contract Form.

In case that you create your own work contract, ensure that the contract contains at least the minimum information as mentioned on Occupational Health and Safety Administration's webpage http://www.tyosuojelu.fi/fi/contract

**Fruits and Berry Farming**
1. Specify clearly what tasks and responsibility are expected to be done from the Employee in Main duties /Principal duties
2. Specify Hourly wages and Piece work wages separately in Salary/wages field.


**Long term employment**
Please clearly specify the following details in the work contract:

1. Overtime payment
How overtime hours will be paid?

Example

Daily overtime payment is the ordinary rate of pay increased by 50% for the first 2 hours and by 100% for the following hours.

Weekly overtime payment is the ordinary rate of pay increased by 50%.

Payment for periodic overtime worked in addition to the regular working time in a three-week period is the ordinary rate of pay increased by 50% for the first 18 hours and by 100% for the following hours. Payment for periodic overtime worked in addition to the regular working time in a two-week period is the ordinary rate of pay increased by 50% for the first 12 hours and by 100% for the following hours.

2. Annaul holiday, Holiday payment

The employee is entitled to 2,5 weekdays of holiday for each full holiday credit month. However, if the duration of the employment relationship has been an uninterrupted period of less than one year by the end of the holiday credit year, the entitlement is 2 weekdays of holiday for each full holiday credit month.

The holiday pay must be paid before the holiday starts, unless the holiday is shorter than 6 days.



Step 2

The Employment contract(s), the Legalization Work Contract Form, and contact information such as Telephone numbers or e-mail of all employees must be sent to The Royal Thai Embassy, Helsinki for prior approval by e-mail or post.

During this process, an employer should inform employees not to proceed with booking/purchasing flight tickets even though they already have a valid visa. This is to avoid any loss of money in case that The Embassy refuses to legalize their contracts.

Step 3

For a case that the Employment Contract(s) is/are approved, The Embassy will post all documents back to the Employer or inform by e-mail. Then the Employer can sign the contract(s) and have them notarized by the local Notary Public.

Note: For a case that the Employment Contract(s) is/are not approved. The Embassy will contact the employer directly and return all documents by post.


Step 4

The aforementioned notarized Employment Contract(s) must subsequently be certified by the Ministry for Foreign Affairs,Finland. (Merikasarminkatu 5 D, 00160 Helsinki Tel 09 160 05)


Step 5

The Employer re-send the original certified Employment Contract(s) together with the Legalization Work Contract Form to the Royal Thai Embassy, Helsinki for the final process.


Note: If you submit the documents by post, please enclose self address return envelope with sufficient stamp.


Step 6

The Employer sends the certified Employment Contract(s) to the Employee in Thailand. The employee then carefully reads the work contract, if everything is fine then he/she can signs their name. After that the employee brings the work contract and report to Thailand Overseas Employment Administration
(http://www.overseas.doe.go.th/) or local labour department in her/her province in order to receive permission to go out from the country. The work contract must be brought along with the employee when traveling to Finland.

Importance notice

Process of checking and considering The Employment Contract(s) and other related documents takes approximately 1-2  weeks or longer, therefore the Employee/Employer should not buy the flight ticket yet.

Working Hours:

The Embassy opens during 9.00-12.00 Monday-Friday,
except public holidays announced by the Royal Thai Embassy, Helsinki.
